1. Agreement to terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Taldar Tech Consultancy Pvt Ltd (“Company”, “we”, “us”, or “our”), a company incorporated in India, having its registered office at 242 Hiran Magari Sector-4, Udaipur, Rajasthan – 313002.

By accessing or using TruckBill (the “Platform”), you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Nature of services

TruckBill is a software platform (SaaS) designed to help transporters and logistics businesses manage:

  • LR (Lorry Receipt)
  • Billing and invoicing
  • Vouchers and payments
  • Compliance tracking (including GST/E-way related workflows)

Important

TruckBill is only a technology platform and does NOT act as:

  • Transporter
  • Broker
  • Logistics provider
  • Financial intermediary

The Company is not responsible for transportation, delivery, goods, or disputes between users and third parties.

3. User responsibilities

By using the Platform, you agree:

  • All information entered is true, accurate, and complete
  • You will comply with all applicable laws
  • You are solely responsible for:
    • Business transactions
    • Financial records
    • Compliance obligations

4. Payment entry & confirmation responsibility (critical clause)

The Platform allows users to record financial transactions including:

  • Payment amount
  • Payer / party details
  • Payment mode (bank, cash, online, etc.)

Mandatory user confirmation

Before saving any payment entry, users are required to:

  • Review all entered details
  • Confirm correctness of:
    • Amount
    • Party name
    • Payment mode

Legal responsibility

The user explicitly acknowledges and agrees that:

  • All entries are made after double confirmation
  • The Company does NOT verify transaction correctness

Liability disclaimer

The Company shall NOT be liable for:

  • Wrong payment entries
  • Incorrect party selection
  • Duplicate entries
  • Financial losses due to user mistakes

The user bears full responsibility for any incorrect financial entry, even if resulting in financial or legal consequences.

5. Compliance responsibility (GST, E-way, tax)

TruckBill may assist in generating or managing compliance-related data.

However:

Users are solely responsible for:

  • GST compliance
  • E-way bill generation and correctness
  • Tax filings
  • Regulatory compliance

The Company shall not be liable for:

  • Incorrect filings
  • Penalties
  • Legal notices
  • Non-compliance issues

6. Data accuracy disclaimer

The Platform processes data provided by users.

The Company does NOT guarantee:

  • Accuracy of invoices
  • Financial reports
  • Calculations based on user inputs

Any output generated is dependent on user-provided data, and users are solely responsible for verifying it.

7. Account security

You are responsible for:

  • Maintaining login credentials
  • All activity under your account

The Company shall not be liable for:

  • Unauthorized access
  • Account misuse due to negligence

8. Payments, pricing & refund policy

  • Subscription and usage fees are payable as per selected plans
  • All payments are non-refundable, unless explicitly stated

Trial policy

  • Trial offers (if any) are subject to separate terms
  • Refund eligibility (if offered) is conditional and time-bound

After expiry of trial/refund window, no refund shall be provided under any circumstances.

9. Prohibited activities

Users shall NOT:

  • Create fake invoices or manipulate records
  • Use the platform for illegal goods transport
  • Misuse GST or E-way bill systems
  • Engage in fraud, misrepresentation, or unlawful activity
  • Attempt unauthorized access or reverse engineering

Violation may result in:

  • Immediate account suspension
  • Legal action

10. Intellectual property

All rights related to:

  • Software
  • Design
  • Branding

are owned by the Company.

Users are granted a limited, non-transferable license to use the Platform.

11. Data ownership

  • Users retain ownership of their business data
  • The Company has rights to:
    • Process
    • Store
    • Use data for service delivery

12. Service availability

The Platform is provided on an:

“AS-IS” and “AS-AVAILABLE” basis

The Company does NOT guarantee:

  • Uninterrupted service
  • Error-free operation

We are not liable for:

  • Downtime
  • Data loss
  • Business interruptions

13. Limitation of liability

To the maximum extent permitted by law:

The Company’s total liability shall NOT exceed the amount paid by the user in the last 6 months.

The Company shall not be liable for:

  • Indirect losses
  • Loss of business
  • Loss of profits
  • Data errors caused by user input

14. Indemnification

You agree to indemnify the Company against:

  • Legal claims
  • Financial losses
  • Penalties

arising from:

  • Your misuse of the Platform
  • Incorrect data entry
  • Non-compliance with laws

15. Termination

We reserve the right to:

  • Suspend or terminate accounts
  • Restrict access

for:

  • Violation of Terms
  • Fraudulent activity
  • Legal risks

16. Modifications

We may update these Terms at any time.

Continued use constitutes acceptance of updated Terms.

17. Governing law & jurisdiction

These Terms shall be governed by the laws of India.

Courts in Udaipur, Rajasthan shall have exclusive jurisdiction.
